Terms of Use

The following forms a legal agreement between you and Qbit Online. By using this site you are acknowledging that you have read, understood, and agree to be bound by these terms and all applicable laws and regulations. If you do not agree to these terms please do not use this site. The material provided on this site is protected by law, including, but not limited to, Taiwan and International Copyright Law and treaties. Any claim relating to the use of this site, its materials and any sales hereunder is governed by the laws of the Republic of China (Taiwan), without regard to conflict of laws and Taiwan will be the sole jurisdiction and venue for any litigation arising from the use of or orders made on the site.

Payment methods

All our Payment methods are thru Paypal and would require customers to have a registered Paypal account. Please remember to not use email links to link to Paypal as the links might lead you to a fraudulent site. Customers should log-in to Paypal direct from their web browser's bookmark or by typing in the URL.

• Credit/Debit/Card payments via Paypal:  All card payments are processed thru Paypal. We do not keep nor will we ever ask for your credit card information.  Customers who chose this payment method will be forwarded to Paypal's payment site after checkout. For registered users of Paypal, you would only need to sign in for payment. If you do not already have an account with Paypal or would not like to register with Paypal, Paypal would require you to enter your billing address, credit card information and contact information again after our delivery information page as a security precaution to prevent identity theft and fraudulent orders. Please make sure you follow thru the PayPal payment process completely until you return and see "Your Order Has Been Received!" to ensure your order is complete.
• Paypal balance / bank funded payments via Paypal: For payment that originates from available Paypal balance or eCheck, sent to us via Paypal. Paypal verification not required. Please do not use credit card for this option as it will be returned. Payment must be received within 3 working days. Orders will begin processing only after receiving payment confirmation. Please note that payments via echeck require around 7 working days to process.

All orders require 48 hours processing time before shipping. No orders will be processed or shipped on weekends or Taiwan national holidays.

Upon receiving the package, please check if there are any evident physical damages to the shipping carton. Should the package arrive damaged, etc., the customer should not accept the item from the courier and report immediately to us and the delivering company that delivered the package for that country.

Customs checks, Import duties and fees
Qbit Online is not liable for fees, taxes or delays caused by other country's custom policies. Please check with your local postal service, import or customs office of any tax/fees that may arise as a result of purchasing the specific product from us. It is the buyer's responsibility to understand their country's laws and regulations regarding any import tax/fees.

Sending items as "Gifts"
Marking a shipment as "gift" also includes lowering the declared value that is allowable per individual for the order's destination country. Qbit Online is not liable for fees, taxes, delays, damage or loss for items marked as "Gift". The package will only be insured up to the declared value should it become lost or damaged. Any compensation that might arise from the lost or damage will be paid by our delivery service at their own discretion.

Lifetime Cash Back Guarantee
Lifetime cash back guarantee is only for selected items. Cash Back value will not be 100% of the original purchase value. Value will depend on the condition, included or missing items and depreciation value over time. All items will be inspected and tested upon receipt. Refunds are transferred to any Paypal account specified by the customer in the original purchased currency. Returns must follow our RMA process as directed. There is a maximum amount refundable for return shipping depending on continent and weight. Qbit Online shall have sole discretion as to the amount credited for refunds.

Any discrepancies including, but not limited to, the following list will result in the package being returned to the customer and credit or replacement will NOT be issued. The following criteria will be followed in rejecting returns and refusing credit:

• Products which are improperly packaged or damaged during shipping.
• Products in non-qualified shipping container (must be in cardboard box with proper amount of insulation)
• Packages affixed with counterfeit label(s) or affixed with labels and/or exhibiting tampering
• Products with any standard certification labels removed (UL listing, capacity, brand name, UPC code)
• Products with serial number which does not match serial number on package or invoice

Manufacturer warranty / Return to Base service
Your product will be covered by the manufacturer's warranty unless otherwise specified. Should you experience any difficulty with your purchase even after the warranty period, you can still contact us for service. We help you act as an intermediary between you and the manufacturer to have the product repaired or replaced under the manufacturer's warranty policy.  Please note that we only act as an intermediary. Items may be repaired or replaced under the manufacturer's discretion and servicing time may vary. All servicing fees arising from parts or repairs will be forwarded directly from the manufacture with no additional service fees from us. Returns must follow our RMA process as directed.

DOA (Dead On Arrival)

DOA's (Dead On Arrival) are an unavoidable aspect of any business model that involves direct shipment to customers. Please understand that Qbit Online ships only products it assumes to be functional and that any defective product you may have received was either damaged in transit or was anomalous. A unit is considered Dead on Arrival (DOA) if the item arrives on-site in a non-damaged carton and does not function properly. If the shipping carton is damaged, the customer should not accept the package and should contact the delivery company and file a complaint immediately. Once the customer accepts the package and notices the product is defective, they can contact the manufacturer local service center for assistance or return to us as RMA for processing. Please see our RMA policy below for details.

The return product is solely under the Customer's responsibility until we receive the product at Qbit Online. Customer agrees to package the return properly and use only reputable carriers capable of providing proof of delivery and insurance for the entire value of the shipment. Customer agrees to bear all shipping and insurance charges and all risk of loss or damage for the return product during shipment.

Technical Support
Qbit Online does not offer any sort of technical assistance. We cannot offer advice on compatibility of items, make product recommendations, provide technical support or sales advice. We post all of the information the manufacturer provides us with for your convenience. Please contact the manufacturer directly for accurate answers to your technical questions or for additional information or specifications that are not posted at Qbit Online.

Change orders
You may request a change to your order provided the order has not already been shipped. Please contact us and provide order number to request a change to your order.

Cancel orders
You may request to cancel an order provided the order has not already been shipped. Please contact us to request an order cancellation. You will receive a credit for the full amount to your credit/debit card in approximately 15 business days.

Product listings
Qbit Online strives for accuracy in all item descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information contained herein or referenced on our website. Due to human error and other determinates we cannot guarantee that all item descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information listed is entirely accurate, complete or current, nor can we assume responsibility for these errors. In the event a product listed on our website is labeled with an incorrect price due to some typographical, informational, technical or other error, Qbit Online shall at its sole discretion have the right to refuse and/or cancel any order for said product and immediately amend, correct and/or remove the inaccurate information. GENERAL TERMS AND CONDITIONS
Payment Terms; Orders: An order is not binding upon Qbit Online until it is accepted; Qbit Online must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. Customer can make payment by credit card, or some other method prearranged with Qbit Online. You agree to pay the amount(s) due as specified on the invoice, and you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.

Shipping Charges
Your total cost for purchase of any product will include shipping and handling charges shown on the Qbit Online invoice.

Title; Risk of Loss
Qbit Online will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point, meaning title to the product(s) -- excepting software-- and risk of loss passes to the Customer upon delivery to the carrier. Qbit Online reserves a purchase money security interest in the product(s) until its receipt of the full amount due. Customer agrees to allow Qbit Online to sign appropriate documents on Customer's behalf to permit Qbit Online to protect its purchase money security interest. Title to software will remain with the licensor(s). All software is provided subject to the license agreement of the software maker. Customer agrees to be bound by any software license agreement once the seal on the package is broken. Qbit Online will advise Customer of estimated shipping dates, but Qbit Online will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.

Governing Law and Jurisdiction
Any dispute arising out of or related to these Terms and Conditions or the sales transaction between Qbit Online and Customer shall be governed by the laws of Taiwan, without regard to its conflicts of law rules. Qbit Online and Customer consent to the exclusive jurisdiction and the exclusive venue of the National Court of Taiwan, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agree not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against Qbit Online that is more than one year after the date of the applicable invoice.

Severability
If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Taiwanese law.

Waiver
The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.

Entire Agreement
These terms and conditions, together with Qbit Online's invoice regarding the products ordered by Customer, are the complete and exclusive agreement between Qbit Online and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between Qbit Online and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.

If you place an order, we use a secure order form for you to provide delivery information such as your name, address and contact information. This information is transmitted and used for billing & delivery purposes and to fulfill your order. If we have trouble processing an order, we will use this contact information to get in touch with you. To properly process your credit card information, we must share your personal and financial information with the merchant bank for authorization and approval (such as PayPal).
